Responsible use policy
RESPONSIBLE USE POLICY — BLIMBOO PLATFORM
This Policy sets out guidelines for the responsible use of the Platform, including examples of products and services that may not be sold through it.
Blimboo acts solely as a payments intermediary and is not a financial institution, a custodian of funds, or a payment account service provider. Users are therefore fully responsible for the products and services they advertise or sell through the Platform.
Financial and payment services — including, without limitation, opening and maintaining a payment account, transaction processing, boleto issuance, transfers, payments, and other fund movements — are provided by ASAAS GESTÃO FINANCEIRA S.A., a payment institution authorized to operate by the Central Bank of Brazil.
Use of the Platform implies agreement with this Policy, with the Policy of Asaas Gestão Financeira Instituição de Pagamento S.A., and with the other contractual documents that govern the relationship with Blimboo, including the Privacy Policy.
Blimboo spends considerable time reflecting on products and services that may be sold on the Platform, assessing trends as certain subjects evolve. This Policy is therefore a living document.
The list of examples below is not exhaustive. It is intended to guide our review teams when assessing possible violations of this Policy, and to clarify to Users some of the main products and services that may not be sold through the Platform.
A. This Policy, which forms part of the Platform’s Terms and Conditions, sets out the guidelines adopted by Blimboo to ensure the security, legality, and integrity of operations carried out through the Platform. Its provisions comply with applicable law, including, without limitation, Law No. 12,965/2014 (Brazilian Internet Civil Framework) and Law No. 13,709/2018 (Brazilian General Data Protection Law — LGPD).
B. Application of this Policy may depend on information available at different times, and we seek to apply it always considering the context and nuances of each Product or Service registered on the Platform.
C. The final decision on accepting a registration, removing or maintaining the sale of a product, service, or Platform account, or adopting any other measure, will always rest with Blimboo, which is responsible for assessing occurrences under the Terms and this Policy.
D. The User is solely responsible for the information they provide and for the products or services they advertise or sell through the Platform, and must comply with applicable law as well as Blimboo’s Terms and Policies.
1. Products that violate applicable law:
You may not use the Platform to create, promote, or sell any Product or Service that violates or may violate applicable law in force.
Examples of such Products and Services include, without limitation:
1.1 Products and Services whose sale or promotion is expressly prohibited by law.
1.2. Products and Services that violate the privacy, honor, intimacy, image, name, or any other personality right of third parties.
1.3. Products and Services that involve the processing of personal data in breach of the Brazilian General Data Protection Law (LGPD), such as the sale of contact lists, databases, or any personal information without an adequate legal basis, the data subject’s consent, or a duly substantiated legitimate interest.
1.4. Products and Services that infringe third-party intellectual property rights. For example, you may not create, promote, or sell on the Platform any Product or Service whose content infringes third-party copyrights, such as rights in music, texts, images, videos, or software. You also may not create, promote, or sell on the Platform Products and Services that contain academic programs or programs developed for an educational institution. You may not create, promote, or sell on the Platform any Product or Service that infringes trademarks, patents, models, industrial designs, or trade secrets. You also may not create, promote, or sell on the Platform any Product or Service that contains OEM software, NFR software, copies, or backup files. Misuse of assets protected by intellectual property rights may result in immediate removal of the content and possible notice to competent authorities, without prejudice to other sanctions provided by law.
1.5. Products and Services with content delivered by someone who does not meet the legal requirements to practice the profession or economic activity to which the Product or Service relates.
1.6. Products and Services that claim, without evidence, to be authorized or recognized by bodies designated by law for that purpose.
2. Products related to fraudulent or unethical activities:
You may not use the Platform to create, promote, or sell any Product or Service involving fraudulent or unethical activities. Examples of such Products and Services include, without limitation:
2.1. Products and Services that induce, teach, or otherwise encourage other Users to violate Blimboo’s Terms or Policies or those of any other company, product, or service.
2.2. Products and Services whose content incites, instructs, or otherwise promotes any illegal conduct.
2.3. Products and Services that fail to provide necessary and adequate information about themselves.
2.4. Products and Services whose content is intentionally misleading and capable of causing harm to their Users or to third parties.
2.5. Products and Services whose content presents information known to be false as if it were true. For example, you may not create, promote, or sell on the Platform any Product whose content publishes news, including media articles, reporting facts as true, or suggesting they may be true, when there is unequivocal evidence that they are false. Blimboo may remove from the Platform any Product it finds to contain such content, regardless of the purpose of using the false content. Blimboo will apply the appropriate measures with particular rigor if it finds that the use of false information is intended to interfere with or unduly influence an election.
2.6. Products and Services that promote pyramid schemes or similar arrangements whose operation depends primarily on financial contributions from new participants to remunerate earlier participants.
3. Products whose formats or content are incompatible with Blimboo’s business model, values, or principles:
You may not use the Platform to create, promote, or sell any Product or Service whose formats or content are incompatible with Blimboo’s business model, values, or principles. Examples of such Products and Services include, without limitation:
3.1. Products and Services related to betting, raffles, sweepstakes, day trading / trading, cryptocurrency, bots, and cheating in online / offline games and services.
3.2. Products and Services whose affiliation opportunity is conditioned on purchasing the Product, and/or Products and Services that teach methods of selling the Product or Service itself.
3.3. Products and Services whose main promotion strategy is the use of the Platform itself, which may lead the audience to believe there is some cost or special requirement to register for or use Blimboo’s Services beyond those already set out in Blimboo’s Terms.
3.4. Crowdfunding Products and Services, or any other fundraising modality, whose main strategy is to raise funds for political and electoral purposes.
3.5. Products and Services in sensitive contexts whose repercussions are still unknown or whose topics require caution in their promotion or exploitation, especially where such caution parameters are not yet well defined by competent authorities, legislation, the courts, or relevant social criteria.
3.6. Products and Services contrary to rules or guidelines issued by national or international public health authorities, whose dissemination may put at risk the health of Platform Users or of the public.
3.7. Health-related Products and Services aimed at lay audiences that, contrary to health rules or guidelines, recommend alternative therapies or treatments with a promise of efficacy against pathologies or their symptoms, capable of putting at risk the health of those who apply them.
3.8. Health-related Products and Services aimed at lay audiences that, contrary to health rules or guidelines, suggest the use of cosmetics or medicines with a promise of resulting in changes to bodily, physical, or mental structure or functions, capable of putting at risk the health of those who apply them.
3.9. Products and Services that advocate any habit that may have harmful consequences for public health.
3.10. Products and Services whose content includes pornographic material, in particular containing explicit scenes, obscene connotations, nudity, or sexual acts.
3.11. Products and Services or services whose promotion invokes compliance with sustainability guidelines without plausible evidence thereof.
4. Products that encourage violence, discrimination, crimes, or prohibited activities:
You may not use the Platform to create, promote, or sell any Product or Service that, directly or indirectly, involves or may involve, incites or may incite violence, discrimination, prohibited activities, or crimes.
Examples of such Products and Services include, without limitation:
4.1. Products and Services whose content promotes violence, threats, intolerance, or intimidation against a person or group of people.
4.2. Products and Services whose content presents a direct attack on a person or group of people based on characteristics such as race, gender, sexual orientation, gender identity, religion, nationality, mental condition, medical condition, or physical condition.
4.3. Products and Services whose content promotes speech intended to dehumanize, degrade, intimidate, or reinforce negative or harmful stereotypes based on characteristics such as race, gender, sexual orientation, gender identity, religion, nationality, mental condition, medical condition, or physical condition. You also may not create, promote, or sell on the Platform any Product whose content directs statements or treatment of that kind at anyone.
4.4. Products and Services whose content, in whole or in part, may constitute a crime or misdemeanor.
4.5. Products and Services whose characteristics indicate or relate to the potential practice of fraud, money laundering, terrorist financing, or illegal activities.
4.6. Products and Services that allude to or promote the illegal use of firearms, narcotics, toxins, or any type of illegal drugs, as well as any illicit substance or any substance whose consumption legally requires a medical prescription or authorization from a competent authority.
4.7. Products and Services that promise success in lotteries or games of chance, as well as in any activity or practice that depends predominantly on luck for its success.
4.8. Products and Services that promote sexual harassment, child sexual exploitation, prostitution, or any other form of sexual exploitation, including the practice or incitement of revenge pornography.
5. Legal Compliance and Cooperation with Authorities
5.1. Blimboo may share User data and information with competent authorities whenever required by law, regulation, or court order, in accordance with its Privacy Policy.
5.2. In addition, it may adopt preventive or corrective measures to curb misuse of the Platform, including, without limitation, suspension, content removal, and account termination.
